As a busy and bustling city, many local drivers need to be wary of people traveling by foot. If a motorist is distracted, intoxicated, or otherwise unsafe behind the wheel, they could collide with nearby pedestrians and cause devastating damage. In such cases, it is possible for the injured pedestrian to seek financial recourse by filing a civil claim with the help of a skilled attorney.
Every case is unique and requires careful consideration to determine fault, damages, and more. An experienced Seattle pedestrian accident lawyer could investigate and pursue your claim to its fullest potential.
Pedestrian Rights Under Seattle Law
Pedestrians have obligations and protections under state law. Revised Code of Washington Chapter 46.61 dictates the rules of the road, including provisions specifically aimed at people traveling by foot. Pedestrians are required to follow all traffic control signals, including stop lights, cross walk signs, and more. Failure to abide by these signals may result in a reduction in potential damages or loss of a claim.
Other provisions in the chapter afford great protections to pedestrians. Drivers are required to utilize reasonable care when around people walking, running, or jogging, and certain safety zones are created to help protect pedestrians. If a motorist fails to abide by these rules, it may help establish a negligence per se claim in addition to a regular negligence claim. A qualified attorney in Seattle could explain these legal theories to an injured pedestrian and properly pursue them when applicable.
Common Causes of Injuries While Traveling by Foot
While many pedestrian accidents do involve motor vehicles, many others do not. People traveling by foot may be harmed as the result of various other causes, such as:
- Improperly marked or maintained crosswalks
- Holes in sidewalks, streets, and other walkways
- Weather hazards caused by negligence
- Dangerous premises
- Slip and fall accidents
These potential causes of harm for a pedestrian, among many others, may be the basis for a successful claim. A well-researched and pursued claim by a skilled local attorney may yield monetary damages for an injured pedestrian.
Steps to Take After Being Injured as a Pedestrian
The first and most important step for any injured pedestrian is to get medical attention right away. This protects not only the plaintiff’s health, but also helps to establish the damages they suffered at the hands of the defendant. This may prove to be a vital source of evidence in a future personal injury claim.
A plaintiff should also seek to keep any and all documents related to their injuries. This may provide proof of negligence and help to establish the damages caused by the defendant. When able, the plaintiff or those who can help should get witness contact information, get copies of police reports, and take pictures of any harms to person or property.
A Seattle lawyer with experience handling pedestrian accident claims, could help the plaintiff understand the potential benefits of filing a claim.
